Robert Walters is hosting a breakfast seminar on 'The Protection of Employees (Temporary Agency Work) Bill 2011', an update on the key issues arising from the Bill, on Wednesday February 8th 2012. The guest speaker is Lorraine Smyth - Partner in the Employment Department of ByrneWallace.
Lorraine will present on current issues pertaining to the Directive on Temporary Agency Work including:
- The rights afforded to Agency Workers under the Directive
- How the Directive may impact on Irish companies engaging Agency Workers
- Important factors to bear in mind when using Agency Workers
About the Directive:
- Came into effect in Ireland on 5 December, 2011.
- Legislation to transpose the Directive is being finalised and a Bill will be published shortly to give legislative effect to the Directive.
- From 5 December 2011, temporary agency workers employed by employment agencies and assigned to work with a hirer, are entitled to equal treatment in basic working and employment conditions in the same way as if directly recruited by the hirer to the same job. This means equal treatment in respect of working time, rest periods, rest breaks, night work, annual leave, public holidays and pay.
- Temporary agency workers will also be entitled, from 5 December 2011, to rights of access to collective facilities and amenities of the hirer such as canteens, crèches etc. in the same way as directly recruited employees.
Lorraine Smyth – Partner, Employment:
Lorraine has extensive experience in all aspects of contentious and non-contentious employment law, acting for both public and private sector clients. She has particular expertise in advising clients on all aspects of transfer of undertakings and has advised several clients through outsourcing, restructuring and redundancy programmes. Lorraine has spoken at a number of seminars, attended mediation hearings, provided in-house training and written articles on employment related topics.
